PRE-INFORMATION FORM

1. PARTIES AND SUBJECT

The subject of this Pre-Information Form is to inform the Buyer in accordance with the provisions of the Law on the Protection of Consumers and the Regulation on Distance Contracts regarding the distance contract between the Buyer and Seller. Additionally, information regarding the matters in Article 5 of the Regulation on Distance Contracts is included in this Pre-Information Form.

  3. This Pre-Information Form provides the Buyer with details of their order, and the Buyer is required to approve the distance sales agreement in accordance with the Regulation on Distance Contracts for purchasing the goods or services electronically. The Buyer can track information regarding the Pre-Information Form and the Distance Sales Agreement on the "My Account" page on TT-TURK.com and change the details of their order from this page. The Pre-Information Form and the Distance Sales Agreement are recorded by the Intermediary Service Provider for the period specified in the relevant legislation, and the Buyer can access these texts at any time from the "My Account" page during this period. Furthermore, after the Buyer confirms the order, the Pre-Information Form and the Distance Sales Agreement specific to each order are sent to the Buyer via email.

  4. The confidentiality rules specified in the Membership Agreement of the Buyer with TT-TURK apply.

3. PAYMENT AND DELIVERY TERMS

  1. The advertised prices and promises are valid until an update or change is made. Prices advertised for a specified period are valid until the end of the mentioned period.

  3. Delivery Terms:

    The shipment of (Product Name and Product Code) will begin within 3 business days following the Buyer’s order for the product or service.
    The product(s) subject to the order will be delivered no later than 30 days from the order date.

  4. THE PRODUCT PRICE IS COLLECTED ON BEHALF OF THE SELLER BY TT-TURK UNDER THE PAYMENT PROTECTION SYSTEM. THE BUYER WILL BE DEEMED TO HAVE PAID THE SELLER FOR THE PRODUCT BY PAYING TT-TURK.

  5. The Buyer, as a consumer, can send requests and complaints through the My Account>Product Questions section on the Digital Platform.

4. RIGHT OF WITHDRAWAL

  1. The Buyer can exercise the right of withdrawal without providing any justification, within 14 (fourteen) days from the delivery date for product sales or from the purchase date for service sales. The Buyer may also exercise the right of withdrawal before the delivery of the product.

  2. The start date for determining the withdrawal period is based on the following:

    1. For goods consisting of multiple items, the day the Buyer or a third party designated by the Buyer receives the last item,

    2. For goods delivered separately under a single order, the day the Buyer or a third party designated by the Buyer receives the last product,

    3. In contracts for regular delivery of goods over a specified period, the day the Buyer or a third party designated by the Buyer receives the first product.

  3. The Buyer can exercise the right of withdrawal by clicking the "Return" link under My Account>Current Orders>My Orders on TT-TURK.com.

  4. The Buyer must fill out the return request form on the relevant page and obtain the return address details and return code from the Seller. The Buyer must return the product within 10 (ten) days from the date they exercise their right of withdrawal.

  5. The product must be returned along with its invoice, the product’s box, packaging, any standard accessories, and other products that were gifted along with it, without missing or damaging any parts.

  6. The Buyer must use the product in accordance with its instructions, technical features, and typical usage limits during the withdrawal period. The Buyer will not be responsible for any changes or damage to the product that occur as long as the product is used in line with the instructions and technical characteristics.

  7. If the Buyer sends the product to the Seller using the return shipping company indicated in the Pre-Information Form, the shipping cost for the return will be covered by the Seller. If the Buyer uses a different shipping company, the Buyer will be responsible for the return shipping cost.

  8. Within 14 (fourteen) days of exercising the right of withdrawal, all payments made by the Buyer for the relevant product or service will be refunded to the Buyer’s original payment method, without incurring any extra cost or charge to the Buyer, in one lump sum.

  9. For purchases made using credit, if the right of withdrawal is exercised correctly, the product cost will be refunded to the credit-associated account.

  10. In case of justifiable reasons preventing the return of the product, the Seller may supply goods/services of equal quality and price before the contract's performance period expires. If the Seller deems it impossible to perform the contract, they must notify TT-TURK within 3 (three) days and ensure that the Buyer is refunded the amount they paid.

  11. If the Buyer requests a corporate invoice, they must either issue a return invoice for the relevant product or, if possible, reject the commercial invoice from their system within the required period.

  12. Upon exercising the right of withdrawal, any side contracts between the Buyer and Seller will terminate without any cost, compensation, or penalty obligations.

  13. The Seller must immediately inform any third party involved in the side contract that the Buyer has exercised their right of withdrawal.

5. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

According to the regulations, the Buyer cannot exercise the right of withdrawal in the following cases:

  1. Contracts related to goods or services whose price depends on fluctuations in financial markets and are not controlled by the Seller (e.g., products in categories such as jewelry, gold, and silver).

  2. Contracts related to goods tailored to the Buyer's personal needs or preferences.

  3. Contracts for the delivery of goods that are perishable or have an expiration date.

  4. Contracts related to goods whose protective elements, such as packaging, seals, or tapes, have been opened after delivery, and whose return is not suitable for health and hygiene reasons.

  5. Contracts related to goods that have been mixed with other products after delivery and cannot be separated by nature.

  6. Contracts related to books, digital content, and computer consumables that have protective elements, such as packaging, seals, or tapes, opened by the Buyer after the delivery of the goods.

  7. Contracts for the delivery of periodicals such as newspapers and magazines, except for those provided under a subscription agreement.

  8. Contracts related to services that must be performed on a specific date or during a specific period, such as accommodation, transportation of goods, car rentals, food and beverage supply, and entertainment or leisure activities.

  9. Contracts related to services provided instantly in electronic environments or intangible goods delivered to the Buyer immediately (e.g., gift cards, gift vouchers, and coupons serving as money).

  10. Contracts related to services that have commenced before the expiration of the withdrawal period, with the Buyer's consent.

  11. Contracts related to the provision of betting and lottery services.

6. DISPUTE RESOLUTION

  1. Under the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, the responsibility for the goods or services sold lies with the Seller. However, Buyers can submit their complaints regarding the purchased goods and services through TT-TURK.

  2. In the event of any disputes related to this Agreement, for disputes up to the value announced by the Ministry of Commerce each year, the Consumer Arbitration Committees in the district or province where the Buyer resides or where the product was purchased will be authorized. For disputes above this value, Consumer Courts will have jurisdiction.
